(AMENDMENT) BILL, 1985

further to amend the Legislative Assembly of 

Meghalaya (Members Salaries and Allowances) Act, 1972.

       Be it enacted by the Legislature of Meghalaya in the Thirty-sixth Year of the Republic of India as follows :-

 

Short title and commencement

1. (1) This may be called the Legislative Assembly of Meghalaya (Members Salaries and Allowances) (Amendment) Act, 1985.

    (2) It shall come into force on and from the 1st day of July, 1985.

 

Amendment of Sections 3 of Act 8  of 1972.

2. In the Legislative Assembly of Meghalaya (Members Salaries and Allowances) Act, 1972 (hereinafter referred to as the principal Act), in Section 3, for the words "rupees six hundred" the words "rupees seven hundred and fifty" shall be substituted.

 

Amendment of Section 4.

3. In the principal Act, in Section 4,-

(i) for the words "rupees four hundred and fifty" occurring in clause (a), the words "rupees six hundred" shall be substituted.

(ii) for the words "rupees forty" occurring in clause (b), the words "rupees fifty" shall be substituted.

(iii) the full-stop "(.)" at the end of the clause (d) shall be substituted by semi-colon "(;)", and

(iv) after the existing clause (d), the following clause shall be inserted, namely :-

"(e) a medical allowances of rupees one hundred per mensem."

 

Amendment of Section 5

4. In the principal Act, in Session 5, for the words "rupees five" the words "rupees ten shall be substituted.

 

Amendment of Section 6.

5. In the principal Act, for the existing Section 6, the following shall be substituted, namely :-

 

"Medical treatment and attendance".

6. A member and members of his family shall be entitled to such facilities for medical attendance and treatment as may be prescribed by Rules made by the Government.

 

Explanation :- For the purpose of this Section the expression "the Members of his family" shall mean and include such Members as may be prescribed by Rules."

 

Amendment of Section 6A.

6. In the principal Act, in Section 6A, for the words "two hundred rupees" occurring in sub-section (2), the words "three hundred rupees" shall be substituted.

STATEMENT OF OBJECTS AND REASONS.

        The Bill seeks to increase the salary of a Member of the Legislative Assembly from Rs.600 to Rs.750, Fixed T.A. p.m. from Rs.450 to Rs.600, Telephone Allowance from Rs.200 to Rs.300, per month and daily Allowance from Rs.40 to Rs.50 and Conveyance Allowance from Rs.5 to Rs.10 per day. It is also proposes payment of Medical Allowances of Rs.100 p.m. and facilities for Medical attendance and treatment as may be prescribed by rules made by Government.

        The proposal are to be made effective from the 1st July, 1985.

FINANCIAL MEMORANDUM

        The Bill when enacted and brought into operation will involve a total additional expenditure of Rs.2,44,800 (approximately) annually.

        It is not possible to give correct estimate as to the expenditure likely to be involved in connection with Daily Allowance and conveyance Allowance as these depend on the number of days members of the Legislative Assembly are required to attend in  connection with their duties as such members.

 

EXTRACT FROM MEGHALAYA ACT 8 OF 1972 OF THE LEGISLATIVE ASSEMBLY OF MEGHALAYA (MEMBERS' SALARIES AND ALLOWANCES) ACT, 1972.

 

Salaries

3. There shall be paid to each member during the whole of his term of office, a salary at the rate of rupees six hundred per mensem.

 

Allowances

4. There shall be paid to each member :-

(a) a fixed travelling allowance of rupees four hundred and fifty per mensem.

(b) for the number of days attended, a daily allowance at the rate of rupees forty, if the member's attendance is required in connection with his duties as such member;

(c) travelling allowance at the rate applicable to a Government servant of the grade I under the subsidiary Rules for journey performed in connection with his duties as such member;

(d) a postage allowance of rupees one hundred per mensem.

 

Conveyance Allowance.

5. There shall be paid to each member for the number of days attended a conveyance allowance at the rate of rupees five per day during the period, the Legislative Assembly is in session and during the period any of its committees hold its meetings.

 

Medical treatment and benefits.

6. A member and the members of his family shall be entitled to such medical treatment and benefits as may be laid down by rules to be made, by the Government.

 

Explanation I :- For the purpose of this section the expression "the members of his family" shall mean and include such member as may be prescribed by Rules.

Explanation II:- Those who are entitled to a free medical attendance and treatment may take the same from any registered physician of their choice - Allopathic, Ayurdevic, Unani or Homeopathic and medical  bill on prescription of such Physicians are reimbursable.

 

Entitlement of Telephone connection and Telephone charges.

6A. (1) Each member shall be entitled to have a telephone connection in a place of his choice where he normally resides or carries on his duties as a member of the Assembly.

     (2) The installation charge and the annual rents of such telephone shall be borne by the Government and the member shall also be paid telephone allowance of two hundred rupees per month for telephone calls and the charges for the charges for the excess over the minimum call permissible to the subscriber

     (3) The telephone allowance under this Section shall be paid to each member irrespective of the fact whether or not telephone connection have provided to him.
