further to amend the Legislative Assembly of 

Meghalaya (Members' Salaries and Allowances) Act, 1972.

       Be it enacted by the Legislature of Meghalaya in the Thirty-ninth Year of the Republic of India as follows :-

 

Short title and commencement

1. (1) This Act may called the Legislative Assembly of Meghalaya (Members' Salaries and Allowances) (Amendment) Act, 1988.

    (2) It shall come into force on and from the 1st day of August, 1988.

 

Amendment of Section 3 of Act 8 of 1972.

2. In Section 3 of the Legislative Assembly of Meghalaya (Members' Salaries and Allowances Act, 1972) (hereinafter referred to as principal Act), for the words "rupees seven hundred and fifty" the words "rupees two thousand" shall be substituted.

 

Amendment Section 4 of Act 8 of 1972.

3. In Section 4 of the Principal Act :-

(i) the words "and" occurring at the end of clause (d) shall be deleted;

(ii) at the end of clause (e), the full stop "(.)" shall be substituted by a semi colon "(;)" and the word "and" added immediately thereafter;

and

(iii) after clause (e), the following shall be inserted as new clause (f), namely :-

"f" where he does not hold any office equivalent to that of a Minister, secretarial allowance of rupees seven hundred and fifty per mensem, with effect from the 1st day of September, 1988 subject to production of a certificate, if any, as may be by rules be prescribed.

 

Explanation - For the purpose of this clause Minister includes the Chief Minister, Deputy Chief Minister, Minister of State and Deputy Minister".

STATEMENT OF OBJECT AND REASONS

        In view of the rise in the cost of living it has become necessary to revise the salary of Members of the Meghalaya Legislative Assembly, the revision is to take effect from the 1st August, 1988. It is also proposed to give with effect from 1st September, 1988 secretarial assistance of Rs.750/- p.m. to Members who are not holding any office equivalent to that of a Minister to enable them to discharge their public functions more effectively.

Hence this Bill.

FINANCIAL  MEMORANDUM

        The Bill when it becomes an Act will entail Rs.14,50,000.00 approximately as additional expenditure from the Consolidated Fund of the State annually.

LEGISLATIVE ASSEMBLY OF MEGHALAYA

(MEMBERS' SALARIES AND ALLOWANCES)

ACT, 1972.

Salaries

3. There shall be paid to each member during the whole of his term of office, a salary at the rate of rupees seven hundred and fifty per mensem.

 

Allowances.

4. There shall be paid to each member :-

(a) fixed travelling allowances of rupees six hundred per mensem.

(b) for the number of days attended, a daily allowance at the rate of rupees fifty, if the member's attendance is required in connection with his duties as such members;

(c) travelling allowance at the rate applicable to a Government servant of the Grade I under the subsidiary Rules for journeys performed in connection with his duties as such member;

(d) a postage allowance of rupees one hundred per mensem; and

                                                                                                                                                             (e) a medical allowance of rupees one hundred per mensem.
